pacman -Syu failing to update

Description
My functioning install stopped updating so I did a clean from CD install and I'm getting almost the same error.
By running "pacman -Syu", it does find the available packages, but eventually errors with the following:
(59/59) checking for file conflicts [#####################################]100%
error: could not prepare transaction
error: failed to commit transaction (conflicting files)
fbsplash: /etc/conf.d/fbsplash.bootsteps exist in filesystem
Errors occurred, no packages were upgraded.
